Across the Pacific Northwest and Alaska, Brett provides counsel and advice to clients on a wide variety of aviation-related claims and insurance issues. In his practice, Brett helps commercial airlines, helicopter and floatplane operators, Part 91 and Part 135 operators, municipalities and airport operators navigate complex disputes, including civil litigation and investigations. Brett’s experience ranges from helping airline clients resolve passenger claims involving in-flight injuries, discrimination and accommodation claims, and other tort claims related to operations above and below the wing, to defending aircraft and helicopter operators and owners after accidents. Brett frequently litigates cases involving federal preemption issues, the Airline Deregulation Act, Air Carrier Access Act, Montreal Convention, and other Federal Aviation Regulations.

In addition to Brett’s aviation practice, he works closely with small businesses and individuals to help resolve contract disputes and provide advice on non-disclosure and non-compete agreements. He also represents his clients in litigating insurance coverage involving liability coverage, property damage, business interruption, and insurance bad faith. He also defends product manufacturers against design defect, manufacturing defect, and other product liability claims.

Prior to going into private practice, Brett served two and a half years at the Washington State Attorney General’s Office. As an Assistant Attorney General, he represented the State of Washington in trial and appellate proceedings involving abused and neglected children.

Representative Work

  • Defended multiple commercial airlines in litigation involving discrimination claims, emotional support animal accommodations and injuries, in-flight injuries, and injuries to ground personnel.

  • Obtained dismissal on summary judgment for commercial airline in negligence claim alleging violation of the federal Air Carrier Access Act.

  • Represented commercial airline and public airport operator in premises-liability action involving a dog bite by a passenger’s emotional support animal. Prevailed on summary judgment.

  • Represented commercial helicopter operator in double-fatality wrongful death action. Jury trial.

  • Defended general aviation operators in cases alleging pesticide drift, pilot error, negligent operations, and other issues.

  • Represented cruise lines in various actions alleging injuries sustained during third-party shore excursion tours.

  • Regularly represent vehicle manufacturers in product liability claims, including claims involving crashworthiness, restraint systems, and other issues.

  • Defended owner of a shopping mall and a security company in a premises-liability lawsuit. Defeated motion to add federal civil-rights claim and associated attorneys’ fees brought on eve of trial.

  • Defended multiple municipalities in personal-injury lawsuits.

  • Represented individual in multi-party breach of contract lawsuit involving a high-value financial services agreement. Obtained favorable settlement, including beneficial non-compete and non-solicitation provisions.

  • Represented technology company in software licensing dispute.

  • Represented homeowners’ association in action against property insurer and insurance agent for insurance coverage relating to fire loss.

Background & Interests

Prior to joining Stokes Lawrence, Brett was an associate with Mills Meyers Swartling. In law school, he worked as an Associate Editor for the Seattle University Law Review and a teaching assistant for first-year contracts students. He previously externed for the Hon. Ronald B. Leighton of the U.S. District Court for the Western District of Washington. When not at work, Brett enjoys hiking, traveling, spending time with his wife, dog, and young son, and refereeing high school and junior college basketball.
