Stokes Lawrence Shareholder Brad Axel was recently quoted in an article posted on Law360.com. The article, “W.R. Berkley Unit Denies Duty To Cover TCPA Fax Blast Deal,” provides an update on an insurance coverage lawsuit involving Nautilus Insurance Co. and GF Protection Inc., which is being represented by Stokes Lawrence.

In the lawsuit, filed in 2012 in the U.S. District Court for the Western District of Washington, GF Protection alleges that Nautilus breached the parties' insurance contract and violated the Washington Insurance Fair Conduct and Consumer Protection Acts by refusing to indemnify GF Protection for the cost of settling an underlying class action lawsuit filed against the company in 2008 for alleged “fax blasting” violations.

Axel noted that a number of courts around the country have found that there is coverage for fax blasting claims under similar circumstances. "[W]e feel there’s a good chance that the [court] would follow the highest courts of these states," he was quoted as saying. The full article can be found here (subscription required).
