Amy Alexander was recently quoted in Law360's article "One by one, states are banning NDAs to protect workers." On March 24, 2022, Washington state Governor Inslee signed into law the Silenced No More Act (Engrossed Substitute House Bill 1795). Washington now becomes the second state after California to render nondisclosure and nondisparagement provisions illegal in employment agreements.  The law, which will apply to Washington employers including Microsoft, Amazon, Starbucks and Costco will take effect on June 9 of this year.

As reported in Law360, the Silence No More Act may result in last-minute settlements as its enforcement date draws near. Amy Alexander said that "If companies have any litigation that won't settle without a nondisparagement or confidentiality requirement, then they should consider settling those before June 9."
