Heather C. Francks
PRACTICE EMPHASIS:
Heather's practice focuses primarily on complex commercial litigation, including class actions and antitrust matters. She also handles bankruptcy matters, assisting clients with day-to-day advice and procedural issues, and representing creditors in bankruptcy proceedings.
REPRESENTATIVE CASES:
- Defended several nationwide and statewide consumer class actions involving Consumer Protection Act violations, false advertising, fraud, Federal Communications Act preemption and filed tariff issues.
- Obtained a significant B&O tax refund from the Washington State Department of Revenue on behalf of a medical services provider. This case was appealed to both the Court of Appeals and Washington State Supreme Court.
- Represented numerous creditors (both individuals and businesses) in various adversary proceedings in bankruptcy court including preference actions and interpleader.
OTHER EXPERIENCE:
After law school, Heather was associated with Shidler, McBroom, Gates & Lucas, and later Preston, Gates & Ellis.
ACTIVITIES:
Heather serves on the core committee of the Thurston County chapter of the ACLU of Washington and is a member of their speakers' bureau.
EDUCATION:
Heather received her law degree from the University of California at Los Angeles School of Law in 1985 and her B.A. in International Relations, from Stanford University in 1982.
ADMISSIONS:
Heather is admitted to the Washington Bar (1985).
